1. Agreement to these terms

These Terms of Service (“Terms”) are an agreement between you and fitfita (“fitfita,” “we,” “us,” or “our”). They apply to our websites, waitlist, mobile and web applications, and related services (collectively, the “Service”). By accessing or using the Service, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility and accounts

You must be at least 13 years old and legally permitted to use the Service. If the law where you live requires a higher age, or consent from a parent or guardian, that requirement applies. If you use fitfita for an organization, you confirm that you have authority to bind it to these Terms.

Information you provide must be accurate and kept current. You are responsible for activity on your account and for keeping sign-in credentials and devices secure. You may not transfer your account or create an account for another person without permission. Tell us promptly about suspected unauthorized access.

3. The Service

fitfita helps people discover activity partners, groups, sessions, and community participation. Features may depend on your location, interests, device permissions, and availability in your region. Joining the waitlist does not guarantee a match, account, invitation, launch date, or continued access to any feature.

We may add, change, test, limit, or discontinue features. The Service may occasionally be unavailable for maintenance, security, or reasons beyond our control. Any future paid feature will show its price and additional terms before purchase.

4. Real-world activity and safety

Exercise, travel, outdoor activity, and meeting people involve risks, including injury, illness, property loss, traffic, weather, terrain, and the conduct of others. Use appropriate judgment, equipment, supervision, and safety precautions. Consider meeting in a public place, telling someone your plans, and checking local conditions. Follow laws, facility rules, and road or trail restrictions.

fitfita does not provide medical, health, coaching, or emergency services. Information in the Service is general and is not a substitute for professional advice. Consult a qualified professional before beginning an activity if appropriate for you. In an emergency, contact local emergency services; do not rely on fitfita.

5. Acceptable use

You must not use the Service to:

• harass, threaten, stalk, discriminate against, exploit, or endanger anyone;
• post illegal, deceptive, hateful, sexually exploitative, or infringing content;
• impersonate a person or organization or misrepresent an activity, route, or achievement;
• collect, reveal, or misuse another person's private or precise location information;
• promote dangerous behavior, cheating, manipulation, spam, or unauthorized advertising;
• access accounts or systems without permission or bypass security or access controls;
• introduce malware, overload the Service, scrape it at scale, reverse engineer it where prohibited, or use automated means except as we expressly allow; or
• help anyone violate these Terms or applicable law.

You can report safety issues or violations through the reporting or support tools available in the Service. We may investigate and take action, but do not promise to monitor every interaction or resolve disputes between users.

6. Your content

You keep ownership of content you submit to the Service. You confirm that you have the rights needed to submit it and that it complies with these Terms. Do not post someone else's personal information or image without appropriate permission.

You grant fitfita a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify for technical or formatting purposes, display, distribute, and otherwise use your content only as needed to operate, improve, secure, and promote the Service according to your settings. This license lasts while your content is available through the Service and for a reasonable backup period afterward. Public content may remain available through copies made by others.

We may remove or restrict content that we reasonably believe violates these Terms, law, or the rights or safety of others. Feedback you voluntarily provide may be used without restriction or compensation, but we are not required to use it.

7. fitfita's rights

The Service, including its software, design, branding, and content supplied by fitfita, is owned by fitfita or its licensors and is protected by law. Subject to these Terms, we give you a limited, personal, revocable, non-exclusive, non-transferable right to use the Service for its intended purpose. No other rights are granted.

8. Third-party services

The Service may rely on or link to third-party maps, geocoding, device location, app stores, communications, analytics, or other services. Their terms and privacy policies apply to their services. fitfita does not control and is not responsible for third-party services, content, or availability. Map, route, and location information may be incomplete or inaccurate; verify important details independently.

9. Communications

You agree that we may send operational messages about your waitlist entry, account, matches, activities, safety, and changes to the Service or these Terms. We may also send marketing where permitted. You can opt out of marketing messages, but not essential service messages. Your carrier's messaging and data rates may apply.

10. Suspension and termination

You may stop using the Service at any time. We may restrict, suspend, or terminate access, remove content, or take protective measures if we reasonably believe you violated these Terms, created risk or legal exposure, or if needed to protect the Service or community. Where practical, we will provide notice. Terms that by their nature should continue—including ownership, disclaimers, liability limits, indemnity, and dispute terms—survive termination.

11. Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available.” fitfita and its suppliers disclaim all express and implied warranties, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, accurate, or error-free, or that any match, user, group, activity, route, result, or content will meet your expectations.

Nothing in these Terms excludes a warranty or consumer right that cannot legally be excluded.

12. Limits on liability

To the fullest extent permitted by law, fitfita and its officers, employees, affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or opportunity, arising from or related to the Service, user conduct, or real-world activities, even if advised that such loss was possible.

To the fullest extent permitted by law, their total aggregate liability for all claims relating to the Service will not exceed the greater of the amount you paid fitfita for the Service during the 12 months before the event giving rise to the claim or US $100. These limits do not apply to liability that cannot legally be limited or excluded.

13. Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold harmless fitfita and its affiliates, officers, employees, and agents from claims, damages, losses, and expenses, including reasonable legal fees, arising from your content, your use of the Service or participation in an activity, or your violation of these Terms, law, or another person's rights. This obligation does not apply to the extent a claim results from fitfita's own unlawful conduct.

14. Governing law and disputes

Before filing a formal claim, you and fitfita agree to try to resolve the dispute informally by giving the other party a written description of the issue and allowing 30 days to respond. Use the contact channel in the Service to send notice to fitfita.

These Terms are governed by the laws that apply where the fitfita entity providing the Service is established, without regard to conflict-of-law rules. Courts in that location will have non-exclusive jurisdiction, unless mandatory law where you live gives you the right to bring a claim elsewhere. Nothing here limits rights you cannot waive under applicable consumer law.

15. Changes to these Terms

We may update these Terms to reflect changes to the Service, law, or our operations. We will post the updated Terms, change the “last updated” date, and provide additional notice of material changes when required. Changes apply from the stated effective date. If you do not agree to the updated Terms, you must stop using the Service.

16. General terms and contact

These Terms, together with any additional terms presented for a feature, form the entire agreement about the Service. If a provision is unenforceable, it will be limited to the minimum extent necessary and the rest will remain effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a business transfer or by operation of law. No third party is a beneficiary of these Terms.
